TERMS OF SERVICE

OVERVIEW

This website and online store are operated by Steward DC Holdings Pty Ltd, trading as QuickRider (“QuickRider”, “we”, “us” or “our”).

These Terms of Service (“Terms”) apply when you visit our website, create an account, communicate with us or purchase products through our online store.

By using our website or placing an order, you agree to these Terms, our Privacy Policy, Return and Refund Policy and Shipping Policy.

If you rent a product from QuickRider rather than purchasing it, your rental will also be governed by a separate rental agreement. If there is any inconsistency relating specifically to a rental, the rental agreement will apply.

Nothing in these Terms excludes, restricts or modifies any right or remedy that cannot legally be excluded under the Australian Consumer Law.

SECTION 1 – ELIGIBILITY AND ACCOUNTS

You must be at least 18 years old, or have the involvement and permission of a parent or legal guardian, to place an order.

You agree to provide accurate, current and complete information when placing an order or creating an account.

You are responsible for protecting your account credentials and for activity conducted through your account. Please notify us promptly if you believe your account has been accessed without authorisation.

SECTION 2 – PRODUCTS AND SPECIFICATIONS

We take reasonable care to ensure that product descriptions, photographs, prices, specifications and availability information are accurate.

Colours and appearance may vary slightly depending on lighting, photography and screen settings. These reasonable variations do not affect any rights relating to products that are materially different from their description.

Electric bicycle range, speed, charging time and performance figures are estimates unless expressly stated otherwise. Actual performance may vary depending on factors including rider weight, terrain, tyre pressure, weather, temperature, battery condition, riding mode, maintenance and level of motor assistance.

We may update product information or discontinue products at any time. Changes will not affect an order that we have already accepted unless we contact you and obtain your agreement or the change is required by law.

SECTION 3 – E-BIKE SAFETY AND LAWFUL USE

Electric bicycles can cause serious injury if used incorrectly. Customers must read and follow all safety instructions, operating manuals and maintenance requirements supplied with the product.

Customers are responsible for:

• Wearing an approved helmet and other appropriate safety equipment
• Conducting reasonable safety checks before riding
• Following applicable road, path, helmet, age and traffic laws
• Using the bicycle only for purposes and locations permitted by law
• Ensuring the bicycle is properly maintained
• Not riding or charging a bicycle that appears damaged or unsafe
• Not modifying or bypassing speed, power, braking, battery or other safety systems

Legal requirements may vary between Australian states, territories and riding locations. Product information on our website is general information and is not a substitute for checking the rules applicable to the place where the bicycle will be used.

Any statement about road-use compliance applies only to the product in the configuration supplied and certified by QuickRider. Unauthorised modifications may make the bicycle unsafe, void the commercial warranty or make its use unlawful.

Products or configurations expressly identified as being for private-property or off-road use must not be used on public roads or paths.

Nothing in this section limits any obligation or liability that cannot legally be excluded.

SECTION 4 – ORDERS

Submitting an order is an offer to purchase. An order is accepted when we send confirmation that it has been accepted or begin preparing the product for delivery or collection.

We may decline or cancel an order before acceptance for legitimate reasons, including unavailable stock, inability to deliver to the requested location, suspected fraud or payment failure. If payment has already been taken for an order we do not accept, we will issue a refund.

Please review the selected model, colour, quantity, delivery information and other order details carefully before completing your purchase.

Cancellation requests are governed by our Return and Refund Policy. We do not accept returns or cancellations solely because a customer changes their mind once an order has been prepared, assembled, dispatched or collected.

Products purchased through our store must not be acquired for unauthorised resale or export.

SECTION 5 – PRICES AND PAYMENT

All prices are displayed in Australian dollars (AUD).

Displayed consumer prices include applicable taxes and unavoidable charges where required by law. Optional delivery charges and optional extras will be shown before the customer completes payment.

Delivery charges may vary depending on the customer’s location, the product and the selected delivery method.

We may offer promotions or discounts subject to separate conditions. Unless stated otherwise, promotions cannot be combined and have no cash value.

Payment must be made using one of the payment methods available at checkout. Payments processed by Shopify, Shop Pay, Afterpay or another provider may also be subject to that provider’s terms, eligibility requirements and privacy policy.

Using a buy-now-pay-later provider does not change the total purchase price or the customer’s obligations under these Terms.

SECTION 6 – DELIVERY AND COLLECTION

Delivery timeframes are estimates and may be affected by product preparation, location, carrier availability, weather or circumstances outside our reasonable control.

We will take reasonable steps to deliver within the estimated timeframe and will provide updates where reasonably possible. Nothing in this section limits rights available under Australian Consumer Law where delivery is unreasonably delayed or does not occur.

Customers must provide an accurate and accessible delivery address. Additional costs resulting from an incorrect address, failed delivery or unauthorised redirection may be charged where reasonable.

Ownership of a product transfers after we have received full payment. Risk of loss or damage transfers when the product is delivered to the nominated address or collected by the customer or their authorised representative.

Local collection and product inspections may be available by appointment. We may request identification or order confirmation before releasing a product.

SECTION 7 – RETURNS, REFUNDS AND WARRANTY

Returns, refunds and order cancellations are governed by our Return and Refund Policy.

QuickRider does not offer returns or refunds solely because a customer changes their mind, selects the wrong model or colour, finds the product cheaper elsewhere or no longer wants the product.

This does not affect rights relating to products that are faulty, unsafe, damaged, incorrectly supplied, not fit for their disclosed purpose or materially different from their description.

QuickRider provides a six-month commercial warranty against eligible manufacturing defects. This commercial warranty is additional to, and does not replace or limit, rights under Australian Consumer Law.

Consumer guarantee rights may continue beyond the six-month commercial warranty period depending on the product, price, expected durability and circumstances.

We may inspect or arrange an assessment of a product before providing a remedy. Depending on whether a failure is major or minor, an appropriate remedy may include repair, replacement or refund.

SECTION 8 – WEBSITE INFORMATION AND AVAILABILITY

We aim to keep the website available and accurate, but we do not guarantee uninterrupted or error-free access.

We may correct typographical errors, technical problems or inaccurate availability information. If an issue materially affects an order that has already been accepted, we will contact the customer and provide an appropriate option consistent with applicable law.

We may temporarily suspend or restrict website access for maintenance, security or operational reasons.

SECTION 9 – INTELLECTUAL PROPERTY

Unless otherwise stated, the website and its content—including the QuickRider name, logos, branding, photographs, videos, graphics, text and layout—are owned by or licensed to QuickRider and are protected by applicable intellectual property laws.

You may use the website for personal and lawful purposes. You must not reproduce, modify, distribute, sell, republish or commercially exploit our content without prior written permission.

Third-party names, trademarks and content remain the property of their respective owners.

SECTION 10 – THIRD-PARTY SERVICES AND LINKS

Our website may contain links to, or integrations with, third-party services such as payment providers, maps, social media platforms or delivery providers.

We are not responsible for the independent content, availability, security or privacy practices of third-party websites. Customers should review the relevant third party’s terms and policies before using its services.

Nothing in this section excludes responsibility that QuickRider has under applicable law for services offered or arranged as part of a customer’s purchase.

SECTION 11 – RELATIONSHIP WITH SHOPIFY

QuickRider is powered by Shopify, which enables us to provide the online store and related services.

Sales and purchases made through this store are directly between the customer and QuickRider. Shopify is not the seller of QuickRider products and is not responsible for fulfilling orders, providing product support or administering QuickRider warranties.

SECTION 12 – PRIVACY

Personal information collected through our website is handled in accordance with our Privacy Policy, available through the website footer.

Because our store is hosted by Shopify, certain personal information is also processed by Shopify and other service providers that help us operate the store, process payments, prevent fraud and fulfil orders.

Some service providers may process information outside Australia. Further details are provided in our Privacy Policy and Shopify’s applicable privacy documentation.

SECTION 13 – REVIEWS AND FEEDBACK

If you submit a product review, photograph, comment or other feedback, you confirm that you have the right to provide it and that it is accurate, lawful and does not infringe another person’s rights.

You grant QuickRider a non-exclusive, worldwide, royalty-free licence to use, reproduce and display that feedback for operating and promoting the business.

We may moderate or remove content that is unlawful, misleading, abusive, offensive, fraudulent or infringes another person’s rights.

SECTION 14 – PROHIBITED USES

You must not use the website:

• For an unlawful or fraudulent purpose
• To interfere with the website’s security or operation
• To introduce malicious code
• To collect another person’s information without authority
• To impersonate another person or business
• To infringe intellectual property, privacy or other legal rights
• To submit false or misleading information
• To scrape, copy or commercially exploit website content without permission
• To harass, threaten or abuse our staff, customers or other persons

We may suspend access where we reasonably believe these Terms have been seriously violated.

SECTION 15 – DISCLAIMER AND LIMITATION OF LIABILITY

Nothing in these Terms excludes, restricts or modifies:

• Consumer guarantees under Australian Consumer Law
• Liability for fraud, wilful misconduct or misleading conduct
• Liability for personal injury or any other liability that cannot legally be excluded or limited

To the extent permitted by law, QuickRider is not liable for indirect or consequential loss that was not reasonably foreseeable and was not caused by our breach of these Terms, negligence or failure to comply with applicable law.

Customers remain responsible for losses caused by their misuse, unsafe operation, unauthorised modification or failure to maintain a product properly.

SECTION 16 – TERMINATION

We may suspend or terminate access to the website where reasonably necessary because of unlawful activity, fraud, security risks or a serious breach of these Terms.

Termination does not affect rights, obligations, payments or claims that arose before termination.

SECTION 17 – SEVERABILITY AND WAIVER

If part of these Terms is found to be unlawful or unenforceable, that part will be severed or interpreted to the minimum extent necessary. The remaining provisions will continue to apply.

A failure or delay in enforcing a right does not waive that right.

SECTION 18 – GOVERNING LAW

These Terms are governed by the laws of New South Wales, Australia.

The parties submit to the courts of New South Wales and any courts entitled to hear appeals from those courts, subject to any rights a customer may have under applicable consumer law.

SECTION 19 – CHANGES TO THESE TERMS

We may update these Terms to reflect changes to our business, services, technology or legal obligations.

The current version will be published on this page with its effective date. Changes will apply prospectively and will not remove rights that arose from an order placed before the change.
